This Privacy Policy for personal data (hereinafter — the “Privacy Policy”) applies to all the information which the Center Soya LLC website (hereinafter — the “Website”) being located on the domain name csoya.ru (as well as on its subdomains) may receive in respect of the User while using the csoya.ru website (or its subdomains), its programs and products.
1.1 The below terms shall be used in this Privacy Policy:
1.1.1. “Website administration” (hereinafter referred to as “the Administration”) means the employees authorized to administrate the Center Soya LLC website and acting on behalf of Center Soya LLC, who arrange and/or perform the processing of personal data, and also determine the goals of personal data processing, the content of personal data to be processed, the actions (operations) performed with personal data.
1.1.2. “Personal Data” means any information relating directly or indirectly to an identified or identifiable natural person (personal data subject).
1.1.3. “Processing of Personal Data” means any action (operation) or any set of actions (operations) performed with personal data using automation tools or without using such tools, including collecting, recording, systematizing, storing, clarifying (updating, changing), retrieving, applying, transferring (distribution, provision, access), depersonalizing, blocking, deleting, destructing of Personal Data.
1.1.4. “Personal Data Privacy” means a mandatory requirement for the Operator or another person having gained access to the personal data not to allow their dissemination without the personal data owner consent or other legal grounds.
1.1.5. “Center Soya LLC website” means a collection of interconnected web pages located on the Internet at a unique address (URL): csoya.ru, as well as at its subdomains.
1.1.6. “Subdomains” means the pages or a collection of pages located on third-level domains belonging to the Center Soya LLC website, as well as other temporary pages, which show the Administration contact information at their bottom.
1.1.5. “Center Soya LLC website User” (hereinafter referred to as the User) is a person having access to the Center Soya LLC website via the Internet and using the information, content and products of the Center Soya LLC website.
1.1.7. “Cookies” means a small piece of data sent by a web server and stored on the user’s computer, which the web client or web browser sends to the web server in an HTTP request at every attempt to open a page of the relevant website.
1.1.8. “IP address” means a unique network label of a computer network node through which the User gains access to the website.
1.1.9. “Product“ means a product that the User orders on the website and pays for through payment systems.
2.1. Using the Center Soya LLC website by the User means his/her consent to this Privacy Policy and the terms and conditions for processing the User’s personal data.
2.2. In case of non-consent to the terms of the Privacy Policy, the User must stop using the Center Soya LLC website.
2.3. This Privacy Policy applies to the Center Soya LLC website. The website does not control, nor is responsible for, the third-party websites which the User may click through the links available on the Center Soya LLC website.
2.4. The Administration shall not verify the authenticity of personal data provided by the User.
3.1. This Privacy Policy sets forth the Administration’s obligations on non-disclosing and ensuring the privacy of personal data that the User submits at the request of the Administration when registering on the Center Soya LLC website, or when subscribing to the e-mail newsletter or when placing an order.
3.2. The personal data authorized for processing hereunder shall be provided by the User through filling out special forms at the Center Soya LLC website and shall include the following information:
3.2.1. surname, name, patronymic of the User;
3.2.2. The User’s contact telephone number;
3.2.3. E-mail address
3.2.4. The User’s place of residence (if necessary)
3.2.5. Goods delivery address (if necessary)
3.2.6. photo (if necessary).
3.3. The website shall protect the data which are automatically transferred when visiting its pages:
— IP address;
— information from cookies;
— browser information
— access time;
— referrer (address of the previous page).
3.3.1. Disabling the cookies may result in the inability to access certain website parts requiring the authorization.
3.3.2. The website shall collect statistical data on IP addresses of its visitors. This information shall be used to prevent, detect and solve any technical problems.
3.4. Any other personal information not specified above (history of visits, the browsers used, operating systems, etc.) is subject to reliable storing and non-distribution except the cases stipulated in p.p. 5.2. and 5.3. hereof.
4.1. The Administration may use the User’s personal data for the purpose of:
4.1.1. identifying the User registered on the Center Soya LLC website for his/her further authorization, placing an order and other actions.
4.1.2. providing the User with access to personalized data available on the Center Soya LLC website.
4.1.3. establishing feedback with the User, including the sending of notifications, inquiries on the use of the Center Soya LLC website, on the rendering of services and the processing of requests and applications from the User.
4.1.4. determining the location of the User to ensure security and prevent fraud.
4.1.5. confirming the accuracy and completeness of the personal data provided by the User.
4.1.6. creating an account to use parts of the Center Soy LLC website, if the User has agreed to create an account.
4.1.7. notifying the User by email.
4.1.8. providing the User with effective technical support in case of problems related to using the Center Soya LLC website.
4.1.9. providing the User, upon his/her consent, with special offers, pricing information, newsletters and other information on behalf of the Center Soya LLC website.
4.1.10. exercising promotion activities, upon the User consent.
5.1. The processing of the User personal data shall be carried out without any time limit, by any legal means, including the use of personal data information systems with automation tools or without such tools.
5.2. The User agrees that the Administration may transfer personal data to third parties, in particular, to courier services, mailing institutions (including the electronic ones), telecommunication operators, solely for the purpose of executing the User’s order placed on the Center Soya LLC website, including the delivery of a Product, documentation or e-mail messages.
5.3. The User’s personal data may only be transferred to authorized bodies of state power in the Russian Federation on the grounds and in the manner established by the law of the Russian Federation.
5.4. In case of loss or disclosure of personal data, the Administration has the right not to inform the User of the loss or disclosure of personal data.
5.5. The Administration shall take the necessary organizational and technical measures to protect the User personal information from unlawful or accidental access, destruction, alteration, blocking, copying, dissemination, as well as from other illegal actions by third parties.
5.6. The Administration together with the User shall take all necessary measures to prevent any losses or other negative consequences caused by the loss or disclosure of the User’s personal data.
6.1. The User may:
6.1.1. take a free decision on giving his/her personal data required for using the Center Soya LLC website, and give consent to their processing.
6.1.2. update or supplement the previously provided personal data information in case of change in such information.
6.1.3. The User has the right to receive information from the Administration regarding the processing of his/her personal data, unless this right is limited pursuant to the federal laws. The User may demand from the Administration to adjust his/her personal data, block or destroy them in case the personal data are incomplete, outdated, inaccurate, illegally obtained or not necessary for the stated purpose of processing, as well as take law-stipulated measures to protect his/her rights.
6.2. The Administration shall:
6.2.1. use the information received solely for the purposes specified in paragraph 4 hereof.
6.2.2. ensure the storage of confidential information in secrecy, not disclose without prior written permission of the User, nor effect any sale, exchange, publication, or disclosure in other possible ways of the transferred personal data of the User, except p.p. 5.2 and 5.3. hereof.
6.2.3. take precautions to protect the confidentiality of the User personal data in accordance with the procedure commonly used to protect such kind of information in the existing business practices.
6.2.4. block the personal data related to the respective User from the moment of application or request by the User or his/her legal representative or an authorized body for the protection of rights of personal data subjects for a verification period, in case of revealing inaccurate personal data or illegal actions.
7.1. The Administration having defaulted on its obligations shall be liable for the losses incurred by the User in connection with unlawful use of personal data, in accordance with the law of the Russian Federation, except cases provided for in p.p. 5.2., 5.3. and 7.2. hereof.
7.2. In case of loss or disclosure of Confidential Information, the Administration shall not be liable if this confidential information:
7.2.1. became public before its loss or disclosure.
7.2.2. had been received from a third party before it was received by the Resource Administration.
7.2.3. was disclosed upon the User consent.
7.3. The user shall be fully responsible for compliance with requirements of Russian Federation law, including the laws on advertising, on the protection of copyright and related rights, on the protection of trademarks and service marks, but not limited to the above, including the full responsibility for the content and form of materials.
7.4. The User acknowledges that the responsibility for any information (including, but not limited to: data files, texts, etc.), to which he/she may have access as to a part of the Center Soya LLC website, shall lay with the person having provided such information.
7.5. The User agrees that the information provided to him/her as a part of the Center Soya LLC website may be an intellectual property to which the title is protected and belongs to other Users, partners or advertisers who place such information on the Center Soya LLC website.
The User shall not be entitled to make changes, lease, lend, sell, distribute or create derivatives based on such Content (in whole or in part), except when such actions are expressly authorized in writing by the owners of such Content in accordance with terms of a separate agreement.
7.6. The text materials (articles and publications freely available to the public on the Center Soya LLC website) may be distributed, provided there is a link to the website.
7.7. The Administration shall not be liable to the User for any loss or damage incurred by the User as a result of deletion, failure or impossibility to save any Content or other communication data contained on or transmitted through the Center Soy LLC website.
7.8. The administration shall not be liable for any direct or indirect losses incurred due to: the use or impossibility to use the website or individual services; unauthorized access to communications of the User; statements or behavior of any third party on the website.
7.9. The administration shall not be responsible for any information placed by user on the Center Soya LLC website, including, but not limited to, the information protected by copyright, without the express consent of the copyright holder.
8.1. Prior to filing a lawsuit to the court on disputes arising from the relations between the User and the Administration, it is mandatory to submit a claim (a written proposal or an electronic proposal for a voluntary settlement of the dispute).
8.2. The claimee shall notify the claimant in writing or electronically of the claim examination results within 30 calendar days from the date of receiving the claim.
8.3. If no agreement is reached, the dispute shall be referred to the Arbitration Court of the city of Krasnodar, Krasnodarski Krai, the Russian Federation.
8.4. The law of the Russian Federation currently in force shall apply to this Privacy Policy and the relations between the User and the Administration.
9.1. The Administration may introduce amendments hereto without consent of the User.
9.2. The new Privacy Policy shall come into effect from the moment it is placed on the Center Soya LLC website, unless otherwise stipulated in the new version of the Privacy Policy.
